Terms of use

Kelmae allows users to capture photos and videos accompanied by motion data, save or export creations, and use Konnect to transmit certain data live from the Subject to the Filmer. Access to features requiring an account entails creating a personal account, providing accurate information and protecting login credentials. The user must promptly report any unauthorised access to contact@kelmae.com.

Depending on the features used, the application requests access to the camera, microphone, location and photo library or storage. Users can manage this access in their phone settings. Refusal limits dependent features; the application must explain this when requesting access. Speed, altitude, position, heading and route values are indicative: they depend on the phone, sensors, signal and network and are not certified instruments.

Users retain their rights in their creations. They warrant that they hold the necessary rights in content they capture, use or distribute and must respect image rights, privacy and third-party rights. Filming a person does not automatically authorise publication of their image. Images of minors require heightened care and, where required by law, consent from holders of parental authority. Covert filming or surveillance, harassment, impersonation, distributing unlawful content and infringing another person’s rights are prohibited.

Users must follow the safety and traffic rules of their activity. They must not operate the application when doing so compromises driving, piloting or anyone’s safety. Data displayed by Kelmae does not replace instruments, instructions or decisions necessary for safety.

To provide requested features, the user authorises CARBYO, to the extent necessary, to technically process their content: display, editing with widgets, export, storage or transmission where these operations are actually offered and selected. This authorisation is limited to providing the service and to the necessary duration. CARBYO does not commercially exploit user creations for advertising or promotion without separate permission.

One-off sharing is triggered by the user. If automatic sharing is offered, it remains disabled by default; activation identifies the relevant content and recipients or services and states that no additional confirmation is requested for each transmission. The user may disable it at any time. Disabling stops future transmissions; it does not automatically remove copies already received or published on third-party services.

Konnect is offered as an open beta. The Subject sends the Filmer the motion data required for the session, including position, speed, altitude and heading where available. Before joining the session, the Subject receives clear information about this transmission and the possibility that the Filmer may record a photo or video incorporating this data and the Subject’s image. The Filmer remains responsible for obtaining the permissions required before any distribution. Participation in Konnect does not, by itself, constitute general permission to publish or share automatically.

During the beta, Konnect may change and experience interruptions. CARBYO may modify or suspend a feature to maintain its security or operation, subject to mandatory rights and guarantees. Any diagnostics are described in the privacy policy.

CARBYO may restrict an account in the event of serious abuse, infringement of third-party rights or a security risk, with appropriate notice where possible. French law applies, without depriving consumers of mandatory protections granted to them. Complaint and consumer mediation arrangements will be completed if a paid offering is launched.
